Welcome to AI Ethos. These Terms and Conditions govern your access to and use of https://aiethos.com.au/, including course pages, account registration, online learning content, enquiry forms, discovery-session booking links, newsletter subscriptions, payments and related services made available through the website. The website is operated by Cyber Ethos Australia Pty Ltd (ABN 42 657 535 307), trading as AI Ethos. In these Terms, "AI Ethos", "we", "us" and "our" refer to Cyber Ethos Australia Pty Ltd trading as AI Ethos. By accessing the website, creating an account, enrolling in a course, making a payment, submitting an enquiry, booking a session, subscribing to updates or using our services, you agree to these Terms. If you do not agree, you must not use the website or purchase a course from us.
In these Terms:
"Course" means any self-paced course, instructor-led program, team training or other learning service we make available.
"Course Materials" means the videos, text, templates, assessments and other content provided as part of a Course.
"Learner" means the individual enrolled in and accessing a Course, whether directly or through an Organisation.
"Organisation" means an employer, institution or other entity that enrols one or more Learners.
"Access Period" means the period during which a Course remains available to a Learner, as stated on the relevant course page or agreement.
AI Ethos provides online and professional learning pathways, including AI, cybersecurity, automation, emerging technology, digital transformation and certification-focused training programs. Our services may include self-paced courses, instructor-led training, organisation or team training, learning resources, videos, assessments, course materials, certification-related information, newsletters, blogs, discovery sessions and support services. Some certifications, course names, badges, examination structures or learning pathways may be provided under licence, partnership or reference to third-party certification bodies or technology providers. Third-party names and trademarks remain the property of their respective owners.
You may use the website and purchase courses only if you are legally capable of entering into a binding agreement. If you are under 18 years of age, you must use the website and enrol in any course only with the consent and supervision of a parent, guardian, school, employer or authorised organisation. Where an organisation, employer, institution, parent or guardian enrols a learner, that person or organisation is responsible for ensuring the learner's use of the course complies with these Terms.
To access certain courses, learning materials or features, you may be required to create an account. Registration may require first name, last name, email address, contact number, password and other information reasonably required for enrolment, support, certification, billing or course delivery. You must provide accurate, complete and current information. You are responsible for keeping your login details confidential and for all activity under your account. You must notify us promptly if you suspect unauthorised access to your account. We may suspend, restrict or terminate an account where we reasonably believe it has been misused, compromised, used by another person, linked to payment issues or used in breach of these Terms.
When you enrol in a course, you purchase access to the course or training service described on the relevant course page, checkout, proposal, quotation or invoice. Course details may include the course title, category, format, duration, assessment structure, certification information, access period, price, included materials and any prerequisites or recommended knowledge. You are responsible for reviewing course details before purchasing. Course information is provided in good faith. We may update, replace, correct or discontinue content where reasonably necessary, including to reflect technology changes, certification-provider requirements, legal requirements, quality improvements or operational needs.
Self-paced courses allow learners to access learning materials online and progress at their own pace, subject to any stated access period or expiry date. Unless otherwise stated in writing, course access is personal to the enrolled learner, non-transferable, starts when payment is confirmed or access is issued, and may expire after the stated access period. Completion depends on the learner's own participation and progress. Course completion, certification and assessment outcomes are not guaranteed unless expressly stated and all requirements are met.
For instructor-led, in-person, corporate, team or custom training, additional terms may apply through a proposal, quotation, invoice, statement of work, booking confirmation, email confirmation or separate agreement. These additional terms may cover training dates, number of participants, venue, online delivery method, trainer availability, custom curriculum, payment milestones, cancellation or rescheduling rules, travel costs, participant obligations and organisation-specific deliverables. If there is an inconsistency between these Terms and a signed written agreement with us, the signed agreement applies to the extent of the inconsistency.
Prices are displayed on the website or provided in a written quotation or invoice. Prices may be displayed in AUD, USD or another currency depending on the course, provider or payment configuration. You must check the displayed currency before payment. Where applicable, GST and other taxes may be added to or included in the displayed price. If GST applies, we may issue a tax invoice or receipt in accordance with Australian tax requirements. Prices may change at any time. Price changes do not affect a course already purchased unless there has been an obvious pricing error. We may correct pricing errors, including prices incorrectly displayed as free, unavailable, incomplete, "N/A" or materially lower than intended. Price corrections apply only before your order is confirmed and payment is accepted; they do not apply to a course you have already paid for and been given access to.
Payment must be made using the payment methods made available on the website or stated in an invoice or quotation. We may use third-party payment processors to process online payments. Unless expressly stated otherwise, we do not intentionally store full credit card numbers on our own systems. Your card or bank statement may show a charge from "Cyber Ethos Australia Pty Ltd" — this is our registered company name; AI Ethos is our trading name and the same business. Payment processing may be subject to the terms and privacy practices of the relevant payment provider. Your enrolment may not be confirmed until payment has been successfully received or approved. If payment is declined, reversed, disputed or charged back, we may suspend or cancel course access until the issue is resolved.
Nothing in these Terms excludes, restricts or modifies any rights you may have under the Australian Consumer Law or any other law that cannot be excluded, restricted or modified. Our courses and services come with guarantees that cannot be excluded under Australian Consumer Law where those laws apply. You may be entitled to a remedy, such as a refund, replacement, re-supply or other appropriate solution, if a course or service fails to meet a consumer guarantee. We do not provide an automatic refund for change of mind, selecting the wrong course, lack of time to complete a course, failure to meet course or assessment requirements, device or internet issues outside our control, or substantial use of course access where the service was supplied as described and no consumer guarantee has been breached. Each refund request will be assessed on its merits and in accordance with Australian Consumer Law. We will acknowledge your request within 3 business days and aim to give you a decision within 14 business days of receiving all information reasonably required to assess it. To request a refund or other remedy, contact us at hello@aiethos.com.au with your name, enrolment email, course name, purchase date, receipt or invoice number if available, reason for the request and any supporting information. If a refund is approved, it will generally be processed back to the original payment method unless another method is required or agreed. Refund processing times may depend on your bank, card provider or payment processor.
If you experience technical issues accessing a course, you must contact us as soon as reasonably possible. We will use reasonable efforts to help resolve access issues within our control. We are not responsible for access issues caused by your internet connection, device, browser settings, firewall, VPN, workplace restrictions, incorrect login details, third-party outages outside our control, payment failure, account misuse or failure to follow reasonable technical instructions. Where an issue caused by us materially prevents access to a paid course for an unreasonable period, we will provide an appropriate remedy required by law, which may include restoring access, extending access, re-supplying the service, or another remedy under Australian Consumer Law.
Some courses may include or relate to certification, assessment or examination pathways. Certification requirements may be set by us or by a third-party certification provider. Completing course content does not automatically guarantee certification unless expressly stated. Certification may require passing an exam or assessment. Exam rules, retake rules, identity verification and certificate issuing may be controlled by a third-party provider. You must not cheat, copy answers, impersonate another learner, allow another person to complete work on your behalf, misuse AI tools where prohibited, manipulate exam systems or breach assessment integrity rules. We may suspend access, withhold completion confirmation or notify the relevant certification provider if we reasonably suspect misconduct, fraud or misuse.
Our courses are designed for education, professional development and skills improvement. We do not guarantee employment, promotion, salary increase, business growth, certification success, regulatory compliance, cybersecurity maturity, AI transformation success, admission into any program or any specific personal, professional, commercial or financial outcome. Testimonials, examples, case studies and course outcomes are provided for general information and do not guarantee that you will achieve the same results.
Website and course content is provided for general educational and informational purposes only. It is not legal, financial, medical, psychological, cybersecurity incident response, compliance, employment or professional advice tailored to your circumstances. You should seek independent professional advice before relying on course content for high-risk legal, financial, health, security, compliance, operational or business decisions.
You must use the website and learning platform lawfully, respectfully and only for the purpose for which access is provided.
Where you breach this clause, we may issue a warning, suspend your access, or terminate your account, depending on the nature and seriousness of the breach; where reasonably practicable, we will notify you of the action taken and the reason for it.
All intellectual property rights in the website, course content, training materials, videos, text, graphics, images, downloads, frameworks, templates, designs, logos, page layouts, software, assessments and other materials are owned by us or licensed to us by third parties. When you purchase a course, you receive a limited, personal, non-exclusive, non-transferable licence to access and use the course materials for your own learning purposes only. You do not acquire ownership of course content or intellectual property. Unless we give written permission, you must not reproduce, distribute, upload, sell, commercially exploit, modify, remove notices from, record or use our course materials to create or improve competing courses, training products, learning platforms or AI systems.
The website may contain links to third-party websites, booking tools, payment providers, certification bodies, learning platforms, video tools or other external services. Third-party services are not controlled by us. We are not responsible for third-party content, availability, privacy practices, payment processing, certification decisions, technical failures, terms or any loss caused by your use of third-party services. You should review third-party terms and privacy policies before using those services.
We collect and handle personal information in connection with registration, enquiries, bookings, course enrolment, payments, support, certification administration, marketing and website operations. We are committed to handling personal information in accordance with applicable Australian privacy laws, including the Privacy Act 1988 (Cth) and the Australian Privacy Principles where they apply to us. Our Privacy Policy explains how we collect, use, disclose, store and protect personal information. It should be read together with these Terms. If there is any inconsistency between this section and our Privacy Policy, the Privacy Policy applies to the handling of personal information.
We may use cookies, pixels, analytics tools and similar technologies to operate the website, improve user experience, remember preferences, understand traffic, improve marketing and monitor website performance. If you subscribe to updates, submit an enquiry, book a session, create an account or purchase a course, we may send you service-related communications by email (and by SMS where you have provided a mobile number for this purpose) and, where you have consented, marketing communications about courses, training, events and related services, by the same channels. You may unsubscribe from marketing communications, on any channel, at any time.
We take reasonable steps to protect the website, learning platform and personal information from misuse, interference, loss, unauthorised access, modification and disclosure. No website, online platform, payment system or internet transmission can be guaranteed to be completely secure. You are responsible for using strong passwords, keeping login details confidential and ensuring your own device and internet connection are secure.
We aim to keep the website and course platform available, but we do not guarantee uninterrupted or error-free access. Access may be affected by maintenance, updates, hosting issues, third-party service outages, cybersecurity events, internet disruptions, payment provider issues, certification provider changes or circumstances outside our reasonable control. Where a paid course is materially affected by an issue within our control, we will provide a remedy required by law or an appropriate practical solution such as restored access, extended access or re-supply.
We aim to ensure website and course information is accurate, current and complete. However, technology, AI, cybersecurity, certification requirements and professional practice change quickly. We may update content from time to time. To the maximum extent permitted by law, we do not warrant that all website content will always be complete, current, free from errors or suitable for your specific circumstances.
If you submit comments, questions, assignments, feedback, reviews, testimonials, enquiries or other content to us, you warrant that the content is accurate and lawful, that you have the right to submit it, and that it does not infringe another person's rights or contain confidential information unless you are authorised to provide it. You grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, store and display your submitted content for the purpose of providing services, responding to you, improving our services, internal administration and, where you have consented, marketing or testimonials. We are not obliged to publish any submitted content, and may decline to publish or remove content that breaches these Terms, is unlawful, or is reasonably inconsistent with our editorial or community standards.
You must not use the website, course content or learning materials to create a competing course, train employees or third parties outside permitted enrolment, resell access, build a commercial training program, create derivative materials for sale, copy our course structure or use our content to develop competing AI, LMS, training or certification products. Corporate or institutional use requires written approval or a separate agreement.
We may suspend, restrict or terminate access if you breach these Terms, payment is not received or is reversed, you misuse course materials, you share account access, you engage in academic misconduct, you create legal, security or operational risk, we are required to do so by law, a certification provider requires it or continuing access would be unreasonable. Termination does not affect rights or obligations that accrued before termination. Clauses 7–9 (Payment and Refunds), 15 (Intellectual Property), 17 (Privacy), 25 (Limitation of Liability), 26 (Indemnity), 29 (Governing Law) and 32 (General) continue after termination.
Nothing in this clause limits or excludes any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded, restricted or modified. Subject to that, to the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or economic loss, including loss of profits, revenue, data, business opportunity, goodwill, reputation or expected savings. To the maximum extent permitted by law, our total liability arising from or in connection with a course or service is limited to one or more of re-supplying the service, paying the cost of having the service supplied again, providing a refund, restoring access, extending access or another remedy required under Australian Consumer Law.
You agree to indemnify us, our directors, officers, employees, contractors, trainers, partners and service providers from and against any loss, damage, liability, claim, cost or expense arising from your breach of these Terms, misuse of the website or course platform, infringement of intellectual property rights, unlawful conduct, unauthorised sharing of course materials, fraudulent or misleading information, breach of assessment rules or use of course content in a way that causes harm. This indemnity does not apply to the extent the loss was caused by our negligence, breach of law or breach of these Terms, and is limited to loss that is reasonably foreseeable and directly caused by the relevant act or breach.
We are not liable for delay or failure to perform obligations where caused by events outside our reasonable control, including natural disasters, war, terrorism, civil unrest, pandemic, government action, labour disruption, internet failure, cyberattack, power failure, payment provider outage, hosting outage or third-party platform failure. Where such an event materially affects a paid course, we will take reasonable steps to provide a practical solution, such as rescheduling, restoring access or extending access where appropriate.
We may update these Terms from time to time. The updated version will be posted on the website with a revised "Last updated" date. If we make a material change that affects your existing enrolment or ongoing access, we will notify you at your registered email address at least 14 days before the change takes effect. If you do not wish to continue under the updated Terms, you may cancel the affected enrolment before the change takes effect and receive a pro-rata refund for any unused access. Your continued use of the website or course platform after updated Terms are posted means you accept the updated Terms. Terms that applied at the time of purchase will otherwise continue to apply to that purchase, unless a change is required by law or reasonably necessary for security, operational or compliance reasons.
These Terms are governed by the laws of Queensland, Australia. You agree that the courts of Queensland and the courts entitled to hear appeals from those courts will have jurisdiction in relation to any dispute arising from these Terms, subject to any rights you may have under applicable consumer protection laws.
If you have a complaint or dispute, please contact us first so we can try to resolve the issue. Please include your name, contact details, course name or account email, details of the issue, your preferred outcome and any supporting documents. If we're unable to resolve your complaint directly, we may suggest mediation or another voluntary dispute-resolution process; this does not limit your right to pursue a claim, including under the Australian Consumer Law, through a court or relevant regulator at any time. Nothing in this section prevents either party from seeking urgent legal relief or exercising rights under Australian Consumer Law or other applicable laws.

If any part of these Terms is found to be invalid, illegal or unenforceable, that part will be read down to the minimum extent necessary, and the remainder of these Terms continues in full force. These Terms, together with our Privacy Policy and any signed proposal, quotation or agreement referred to in these Terms, form the entire agreement between you and us on their subject matter. You must not assign or transfer your rights under these Terms without our written consent; we may assign or transfer our rights and obligations in connection with a business transfer, merger or restructure. A failure or delay by us in exercising a right under these Terms is not a waiver of that right. Any notice under these Terms will be treated as received when sent to your registered email address, or when you send it to the contact details in Clause 31. These Terms do not confer any right on a person or entity other than you and us to enforce any of their terms.
